Any booking implies, by full right, the client's adhesion to the conditions below:
• Any stipulations (purchase conditions, letters, acknowledgements of receipt and other documents emanating from the Client) modifying the terms and conditions of this purchase order shall be considered null and void unless they are in writing, approved and signed by FunTrip.
• All bookings can be made by post, fax or telephone.
In this latter case, the booking must be confirmed in writing.
• Services are payable in advance, with a deposit of 50 %, and the balance to be paid at least 30 days before the date of the service.
Failure to pay according to the terms below will result in an increase of amounts due with late payment interest equal to one and a half times the statutory interest rate, commencing from the due date, plus VAT.
• Bookings can be cancelled or modified without penalty, up to 30 days before the service date.
• 90 days before the service is due to be provided, a penalty of 30 % of the value of the reserved services will be deducted
• 60 days before the service is due to take place, a penalty of 50 % of the value of the booked services will be deducted
• 30 days before the service is due to be provided, a penalty of 80 % of the value of the booked services will be deducted
• 15 days before the service is due to be provided, a penalty of 100 % of the value of the booked services will be deducted
• FunTrip cannot in any event be held liable for force majeure events, for acts of third parties unconnected with the provision of services under the contract, or for the poor performance of the contract attributable to the Client.
FunTrip guarantees the financial consequences of the civil liability it may incur in the course of its activities of organising excursions, multi-activity events, and hiring out equipment necessary for the guaranteed activities.
In the absence of an amicable agreement, any disputes concerning these general terms and conditions of sale shall fall under the jurisdiction of the Courts of Cannes or, if the Customer defendant is not a merchant, the commercial court of their domicile.
